• If you wish to terminate your membership with the Quinlan Road Community, please make your request by e-mail to messageboard@quinlanroad.com.
• Termination of your membership will result in the removal of all personal information from your account (excluding username, email address, IP addresses), and the permanent locking of your account.
• For legal purposes and due to technical limitations, your posts and Your Content (as defined below) cannot be removed from the Quinlan Road Community database following a termination of membership request.

The Quinlan Road Community is a family and community oriented service and both children and adults use its features. Filters are in place that will prevent your message from being posted if you use obscene or inappropriate language, but as no filter system can completely eliminate material that may cause offence, please remember that anything that you post here is your own responsibility and we expect you to take utmost care to ensure that it remains friendly, courteous and respectful of others.

When participating in a forum or chat room, never assume that people are who they say they are, know what they say they know, or are affiliated with whom they say they are affiliated. Quinlan Road cannot be responsible for the content or accuracy of any information, and will not be responsible for any reliance or decisions made based on such information.

In light of the above, when using or contributing to the Quinlan Road Community you agree not to:

• Posts or chat messages that are defamatory, slanderous, libelous, harassing or abusive;
• Pornographic or sexually explicit posts, messages, images or other content;
• Posts or chat messages that abuse any person or group based on racial, ethnic or religious affiliation, national origin, physical disability or sexual orientation;
• Posts or chat messages that are likely to leave other users feeling harassed, threatened, bullied, stalked, intimidated or abused, or their privacy invaded;
• Posts or chat messages that promote or endorse any activity that is illegal or offensive;
• Posts or chat messages that contain, or contain links to, files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of our computer systems or those of any user;
• “Spam”, advertising or promotion of commercial services or products and or attempts to fundraise or solicit money from any other Quinlan Road Community members or visitors;
• Content that infringes the rights of a third party (including but not limited to copyrights, trademarks, patents, rights of privacy and trade secrets); and
• Posts or chat messages that contain hyper-links to other sites that contain content that falls within the descriptions set forth above.

Impersonate, or attempt to impersonate, other Quinlan Road Community members or visitors; and

Attempt to obtain a password, account details or other personal and private information from another Quinlan Road Community member or members.

You acknowledge and additionally agree to the following:

• We ask that you do not post, transmit, link to, or otherwise distribute any information, materials or content that does not generally pertain to the designated topic or theme of the particular forum or chat room.
• Use of a forum or chat room for commercial purposes of any kind is strictly prohibited.
• We reserve the right to stop any conduct that restricts or inhibits the community of members from fully utilising and enjoying the Quinlan Road Community.
• We reserve the right to act to delete any and all material that contravenes any of the Terms of Use or which may otherwise have a negative impact on the safe, respectful, legal, friendly and courteous operation of the Quinlan Road Community.
• We reserve the right, but not the obligation, to review and subsequently edit or delete your contributions before they are posted. As a result of such review, there may be a delay in your message(s) being posted to the Quinlan Road Community pending review by the Quinlan Road Community moderators.
• It is the job of the administrator and moderators of the Quinlan Road Community, and no other members or participants of the Quinlan Road Community, to monitor posts and interactions between users. Their duty is to ensure the best possible experience for all participants in the Quinlan Road Community.
• Members who make reference in their posts to websites or other online sources containing unlicensed or illegal Loreena McKennitt or Quinlan Road material will have their posts removed by our moderators.
• In accordance with our Privacy Policy, we reserve the right to disclose any information, including your identity, as necessary to satisfy any legal, regulatory or other governmental request.

• While we do not claim ownership of any information or material that you transmit, distribute, post, communicate or store on, to or through the Quinlan Road Community (“Your Content”) (expressly excluding your user data which is collected in accordance with our Privacy Policy), we do require certain rights to Your Content in order to operate the Quinlan Road Community.
• By submitting or posting Your Content, to or through the Quinlan Road Community, you grant Quinlan Road a world-wide, royalty free, perpetual, irrevocable and non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display Your Content anywhere, for any purpose, and in any form, media or technology now known or later developed and you waive all moral rights in relation thereto. No compensation will be paid with respect to the use of Your Content.
• Quinlan Road is free to use any ideas, concepts, know-how, or techniques contained in Your Content for any purpose whatsoever including, but not limited to, posting, publishing or using Your Content on the Quinlan Road Community and the Quinlan Road/Loreena McKennitt official website.
• Quinlan Road is under no obligation to maintain any of Your Content and may remove any of Your Content at any time in its sole discretion.
• By posting or submitting Your Content to the Quinlan Road Community, you also represent and warrant that you own or otherwise control all of the rights to Your Content, and that use of Your Content by Quinlan Road will not infringe or violate the rights of any third party or constitute violation of any applicable law.

• Materials displayed or otherwise accessible through the Quinlan Road Community, including, without limitation, postings, news articles, text, photographs, images, illustrations, audio clips, video clips, (collectively, the “Content”) do not necessarily reflect the views of Loreena McKennitt, Quinlan Road and its employees, the Quinlan Road/Loreena McKennitt official website, and the companies involved in building, maintaining and hosting the Quinlan Road Community and website.
• As a service to visitors to the Quinlan Road Community, we may include links to other websites over which we have no control. Your decision to access any other such websites is entirely at your own discretion and risk.

BY ACCESSING AND USING THE WEB SITE YOU ACKNOWLEDGE AND AGREE THAT USE OF THE QUINLAN ROAD COMMUNITY AND CONTENT IS ENTIRELY AT YOUR OWN RISK. Limitation of Liabilities:

IN NO EVENT WILL LOREENA MCKENNITT, QUINLAN ROAD OR ITS AFFILIATES, OR ANY PERSON OR PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE QUINLAN ROAD COMMUNITY, BE LIABLE IN ANY MANNER WHATSOEVER FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, (INCLUDING LOST PROFITS, LOSS OF BUSINESS OR DATA, BUSINESS INTERRUPTION, TRADING LOSSES) INDIRECT, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN AN ANY WAY RELATED TO THE QUINLAN ROAD COMMUNITY OR YOUR ACCESS, USE OR INABILITY TO USE THE QUINLAN ROAD COMMUNITY, OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE. THE ABOVE SHALL APPLY EVEN IF QUINLAN ROAD OR ANY THIRD PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.


Indemnity:

Upon a request by Quinlan Road, you agree to indemnify and hold harmless Loreena McKennitt, Quinlan Road and its respective subsidiaries, affiliates, directors, officers, agents, licensors, co-branders or other partners and employees from and against all liabilities, claims and expenses, including legal fees and disbursements on a substantial indemnity basis, made by any third party due to or arising out of your conduct on and use of the Quinlan Road Community, Your Content, your violation of these Terms of Use or your violation of any rights of another.


Governing Law:

These TERMS OF USE shall be governed by and construed and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada as applicable. You hereby irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, Canada, without regard to the conflicts of laws principles.
